Two Plans – District Plan and Maori Land Court – what are the connections between these?

General Rules

What are acceptable volumes for earthworks under the District Plan – does it need to be less or more?
Earthworks near ‘sensitive’ sites, need some notification/discussion when near those sites.
Consents granted by Regional Council and TCC input into those.

Natural Environment

Distance of setbacks from native vegetation – do we have any or need any rules about that.
Who controls pests etc?
What are the implications for reserves?
Contamination of water – Waimapu
Does Council manage reserves – movement of earth into gully
How are areas identified and protected
How to discover the cultural component to values of natural environment. Various means through plan review: hui, individual, hapu (with/without protocols, Hapu without protocols will not be disadvantaged), consultation advisor.

Landscape

Are we proposing a ‘sensitive’ zone adjacent to the coast to address buildings visible to the beach?
A key issue, how are zones defined
Papakainga is it a landscape, or a height, or a house, or a group of housing. Understanding of papakainga is holistic not just housing – the concept of papakainga has many different meanings.
SmartGrowth- has a wide definition – hauora/commercial/housing etc. Do address some of these ideas, need further discussion – need to define for District Plan.
High Rise Policy area not the same as the High Density Zone – need to have clear delineation.
High Rise Zone – community feedback re High Rise Policy to be reversed – need fro Council to debate that.

Culture and Heritage

How does this match the Regional Council’s heritage sites?
How assessed – buildings in CBD – used Regional Councils heritage criteria
Heritage sites in the plan as schedule and on maps identified by a symbol.
Regional Statement – can get from EBOP
How iwi involved in identifying sites. Raised by Councils Tangata Whenua Collective at Regional Policy level that more involvement wanted.

Reserves and waterbodies

Mangrove controls – not in District Plan – is EBOPS authority
Have been requests to national government to look at ways to address this (mangroves) across NZ under NZ Coastal Policy Statement – awaiting the results of this.
Estuary care groups may also be an avenue to explore.
Maori Committee of EBOP can also be another point of contact
Maungatapu – sales of beach accesses – can they do this? – is of concern
Waimapu Stream – water quality testing shows pollutants
Fencing of drains running through rural land (WBOPDC advice for rural areas)
Discharge of pollutants from stock to be discussed EBOP, and for industrial use.

Natural Hazards

Horses and vehicles on the beach – addressed through bylaws
Damaged to infrastructure on the beach from people accessing with vehicles. Disposal of rubbish. Bins on the beach? Litter bylaws
Do we have a risk assessment procedure – Floodable areas.

Residential/Rural

Timeframes and opportunities for input.
Timeframe seems short for inclusion of complex papakainga housing issues into review.
Work being done and been done for SmartGrowth on preliminary identification of sites.
Not everyone hearing and being consulted with through SmartGrowth or other forums (CTWF and TWC)
Future development of tangata whenua section of SmartGrowth website.
Some tangata whenua not affiliated with others and not included in this process.
Feeding back to August consultation period.
Papakainga is a holistic concept – not just housing but includes other facilities, economic development initiatives and the like, rest homes to come within this concept?
